Selwood Limited warranty terms & conditions

  1. In these warranty terms:

    “Company” means Selwood Limited

    “Contract” means a contract under the terms of which the Company is liable to supply Goods and/or Services.

    “Customer” means the party having the right to enforce the supply by the Company of Goods and/or Services of any description under the terms of a Contract.

    “Goods” covers all pumps, other equipment, spare parts and accessories which are the subject of sale by the Company.

    “Services” means any services provided under contract by the Company to the Customer.

  2. The liability of the Company under its warranty in relation to Goods shall be subject to the Goods having been used and maintained wholly in accordance with the manufacturers’ instructions in the owners’ manual, the maintenance and installation instructions supplied by the Company and to their not having been repaired or altered other than by the Company or other than with the Company’s prior written approval. The manufacturers’ instructions and maintenance and installation instructions are contained in an owners’ manual which is delivered to the Customer with each item. The Customer can obtain further copies of this manual by contacting their local Company authorised distributor.

  3. Goods-During a period of whichever period is shorter of twelve calendar months or 2000 hours from the date of the delivery of the Goods to the Customer or eighteen calendar months or 2000 hours from the date of shipment by the Company of any of the Goods the Company will, at its option, repair, or replace at the point of sale, any Goods or any component part of the Goods which are shown to be defective at delivery by reason of faulty workmanship and/or materials, provided that the defect has been notified to the Company within a period of 14 days after it has become apparent. The Customer will be liable for all other associated costs to include, but not limited to, costs for removal, re-installation and freight.

    All replacement parts provided by the Company will be subject to the terms of this warranty except that the date of commencement of the warranty in this case shall be the date of supply of the original Goods.

    Services-Defects in any Services which appear within a period of 30 days after the date the Services have been completed and which are shown to be due to materials and/or workmanship being not in accordance with the Contract, will be made good at the Company’s expense, provided that each defect has been notified to the Company within 7 days of having become apparent.

  4. Where replacement parts or accessories are provided under the terms of this warranty. The Customer will be required to provide a copy of the invoice/s as proof of purchase of the original Goods.
    The serial number or other proof of purchase of the Goods supplied must be provided when a Customer makes a claim under this warranty.

  5. All repairs which are carried out under the terms of this warranty must be undertaken or be authorised by an approved Company distributor, dealer or workshop during normal working hours from Monday to Friday.

  6. The Company’s sole responsibility under this warranty will be to make good or replace Goods or remedy defective Services as provided above. Except where negligence on the part of the Company is shown to have resulted in the death of, or bodily injury to, any person, the Company shall have no liability or responsibility, whether by way of indemnity or by reason of any breach of the Contract, breach of statutory duty or misrepresentation, by reason of the commission of any tort (including but not limited to negligence) or by reason of implied warranty, condition or other term in connection with any Contract, for any loss of profit, loss of use of plant or any other asset or facility, loss of production or productivity, losses caused by delay, loss of reputation, loss of contracts with any third party, liabilities of whatever nature to any third party, and/or any other financial or economic loss or indirect or consequential loss or damage of whatever nature.

  7. The Company reserves the right to make modifications to the Goods which it manufactures and sells at any time without prior notice and without incurring any obligation to make the same or similar changes to Goods previously manufactured or sold.

  8. Where any Customer makes an invalid claim under the terms of this warranty the Company reserves the right to charge the Customer for work carried out and/or parts supplied at the standard prices charged by the Company.

  9. This warranty will not apply to any wet end equipment which is sold separately for inclusion into a canopied unit unless the complete installation has previously been tested and validated by the Company’s Engineering Department and written approval has been issued.

  10. This warranty is not applicable to the mechanical seal, unless failure is present at time of delivery and is attributed to incorrect fitting or failure in materials or workmanship of the seal assembly itself. This warranty does not apply to consumable items such as filters, lubricants, rubber belts, spark plugs and similar accessories or to any items (including without limitation impellers, casings and wear plates) subject to adverse wear caused by use on abrasive applications.

  11. Goods replaced under the terms of the Company’s warranty shall thereby and thereupon become the property of the Company and shall be held by the Customer to the order of the Company.

  12. The Company’s express warranty set out above is given in lieu of and excludes all other warranties, guarantees and assurances whether express or implied, statutory or otherwise to the extent permitted by law.

  13. This warranty will not apply to any damage, alterations or repairs arising from or caused by:

    1. normal wear and tear;

    2. accidental or deliberate damage or vandalism;

    3. failure to follow the servicing and maintenance schedule requirements as specified in the Owners Manual;

    4. third party equipment or software or

    5. legislative requirements.

  14. This warranty does not apply to damage to or caused by engines or other prime movers manufactured by third parties and incorporated into the Goods.

  15. This warranty may not be transferred or assigned without the express written consent of an authorised signatory of the Company. No third party is intended to have any rights to rely on or enforce this warranty.

  16. This warranty is governed by English law and the courts of England and Wales will have exclusive jurisdiction for all purposes connected with this warranty.
